All Formed For sculptures come with a Warranty that covers the original Buyer from any defects in material or craftsmanship. For the purposes of this Warranty, lifetime is defined based on material and finish as follows:
For Bronze, we warrant that each sculpture is free of defects in material and workmanship for a period of Twenty Five years from the date of purchase, and that the patina of each Bronze sculpture shall be free of defects in materials and workmanship at the time of original delivery to the buyer.
For Stainless Steel, we warrant that each sculpture is free of defects in material and workmanship for a period of Twenty Five years from the date of purchase.
For Corten Steel, Painted Steel, Stone and Marble, we warrant that each sculpture is free of defects in both materials and workmanship for a period of Five Years from the date of purchase.
For sculpture bases, we warrant that each base is free of defects in both materials and workmanship for a period of Five Years from the date of purchase.
Buyer acknowledges and agrees that metal and stone finishes can have minor, natural defects inherent in the raw material, as well as variations in color and texture, which may not match samples or renderings shown to Buyer at the time of consultation. All sculptures are hand made and small imperfections in the finish may occur as a natural, uncontrollable characteristic of the fabrication process. Natural aging processes may affect the look and color of unpainted or non-powder coated metal, including but not limited to natural patinas for bronze. Buyer agrees that these imperfections shall not be considered defects.
Where appropriate, a maintenance schedule will be supplied. Where one is supplied, any damage to or degradation of the sculptures which in Suppliers reasonable opinion results from untimely or poor maintenance of the sculptures shall not be covered by the warranty.
Supplier provides all sculptures for appropriate use and will not accept responsibility for any failure resulting from negligence, vandalism, inappropriate or unreasonable use, or incorrect installation.
This Warranty does not cover any sculpture which has been altered, removed from its rightful attachment, or repaired by anyone other than Formed For after delivery to the original Buyer.
This warranty does not cover cosmetic damage or damage due to accident, weather phenomena, misuse, abuse, negligence, or modification of or to any part of the sculpture and/or its base after delivery to Buyer.
Because the patina finish applied to our bronze sculptures is generally considered in the bronze sculpture industry to be a “living finish” which will naturally oxidize and change color over time due to human touch, climate conditions and exposures, degree of proper maintenance, etc., we do not warrant the patina finish of our sculptures beyond being free of defects in materials and workmanship at the time of delivery to the original buyer.
If a sculpture is proven to have a structural or material defect and reported and properly presented to Formed For for warranty service within the prescribed time limit of this Warranty, it will be repaired or replaced at the discretion of Formed For at no further charge to the buyer, other than shipping, which shall be paid by Buyer. Such repair or replacement of the sculpture is the sole liability of Formed For and is the Buyer’s exclusive remedy for any breach of this Warranty.
To the maximum extent permitted by applicable law, in no event and under no legal theory, with respect to claims for breach of contract and claims of breach of confidentiality obligations including Personal Data, neither Party to include their parents, affiliates and subsidiaries shall be responsible to the other for damages, costs and expenses of either party’s personal injury, property damage, consequential, incidental, indirect, punitive or exemplary losses or damages, or any liability for loss of income, loss of revenue, loss of profit, or loss of product, howsoever caused, including negligence, gross negligence, and strict liability.
Coverage under this Warranty terminates prematurely when the sculpture deteriorates for any reason other than defects in workmanship or material.
EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH ABOVE, ALL SERVICES AND MATERIALS ARE PROVIDED “AS IS.” FORMED FOR HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHER, AND SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ALL WARRANTIES ARISING FROM COURSE OF DEALING, USAGE OR TRADE PRACTICE. No dealer, agent or employee of Formed For is authorized to make any modification, extension, or addition to this Warranty. Formed For reserves the right to determine if warranty terms and conditions have been met.
